The purpose of this article is to examine the relationship between philosophy (considered as an expression of fundamental values) and development, this here particularly understood in its economic sense. The author starts with an exploration of the meaning of development and then goes on to evaluate the views and perspectives that tend to argue against philosophy in its broadest sense (that is considered simply as a worldview or as a system of values) occupying a distinct and significant role in development. The Moral Limits of Law analyzes the related debates concerning the moral obligation to obey the law, conscientious citizenship, and state legitimacy. Modern societies are drawn in a tension between the centripetal pull of the local and the centrifugal stress of the global. Boundaries that once appeared permanent are now permeable: transnational legal, economic, and trade institutions increasingly erode the autonomy of states. Nonetheless transnational principles are still typically effected through state law. For law's subjects, this tension brings into focus (...) the interaction of legal and moral obligations and the legitimacy of state authority. This volume incorporates a comprehensive critical analysis of the methodology and substance of the debates in recent legal, political, and moral philosophy, regarding political obligation and the moral obligation to obey the law. The author argues that traditional accounts of political obligation that assume a bounded conception of the polity are no longer tenable. Higgins therefore presents an original theory of the conscientious agent's attitude towards law that accommodates the contemporary social tension between local and global obligations. (shrink)

We discuss the hypothesis that the debate about the interpretation of the orthodox formalism of quantum mechanics might have been misguided right from the start by a biased metaphysical interpretation of the formalism and its inner mathematical relations. In particular, we focus on the orthodox interpretation of the congruence relation, '=', which relates equivalent classes of different mathematical representations of a vector in Hilbert space, in terms of metaphysical identity. We will argue that this seemingly "common sense" interpretation, at the (...) semantic level, has severe difficulties when considering the syntactic level of the theory. (shrink)

The structure of natural languages is usually studied from three major different but interconnected points of view: syntax, semantics, and pragmatics. If we consider that the main purpose of natural languages is communication, we should consider another dimension for languages, which deals with the influence of internal states of communicating individuals on meanings. Such a dimension we refer to as internalism. Within this context, internalism cannot be confused with psycholinguistics, in the same way pragmatics cannot be confused with sociolinguistics. In (...) particular, we argue, language is tied to its systematic use. This view leads us to a non-realist perspective on linguistics. We analyze the role of natural languages into dialogues, by comparing our proposal to the dialogical approach to logic, which considers a dialogue as a game. Within our approach, there is no way to guarantee that two parties involved in a dialogue are playing the same game, due to unavoidable differences in their respective internal states. Another contribution of this paper is to argue that semantics plays a more fundamental role than syntax in the cognitive acquisition of languages. (shrink)

Textbooks Ta‘lîm al-muta‘allim can be an alternative solution to the problems of character education in Indonesia. Inside the book there are methods that specifically leads to holistic learning code like the concept of learning objectives, choose a teacher or school, choosing friends, even mastered a learning method such as learning itself, deliberation, mutharahah, and mudzakarah. This study aimed to analyze the text book Ta‘lîm al-muta‘allim works of Sheikh Az-Zarnuji then compare it with several books of Plato’s philosophy idealism. The method (...) used is the analysis of documents by grouping clauses-clauses in the textbook Ta‘lîm al-muta‘allim in category: metaphysics, epistemology, axiology, the purpose of education, curriculum, method, the position of the students and teachers. Then compare it with documents from various sources about the Platoidealism. The study shows that there are some similarities between SheikhAz-Zarnuji thought with Plato. For example, the similarity between the two is the concept of metaphysics in Ta‘lîm al-muta‘allim called ma’rifatullah, while the concepts included in the Plato called the idealistic concept of macrocosm and microcosm. The similarity was impacted on shared educational goals from SheikhAz-Zarnuji, students and revitalize direction, into individual for himself, to achieve goodness and union with God. The difference mainly stated in the concept of metaphysics specific aspects in their respective reviews. For example, Sheikh Az-Zarnuji said that reality comes from God, while idealism states that the reality can be dug in God through contemplation or idea or reason. (shrink)

Civilizational analysis has not concerned itself too greatly with the historical experiences of the American New World. There are good reasons to correct this position and Shmuel Eisenstadt’s principal work on America’s distinct modernities goes some way to establishing the colonization of the Atlantic world as an opening phase of modernity. Nonetheless, a more far-reaching analysis of the distinctiveness of diverse American societies can be developed that goes beyond the image of a Protestant North America contrasted with southern Latin cultures. This article outlines the basis for a more nuanced approach in three steps: a focus on intercivilizational engagement, examination of civilizational factors neglected by Eisenstadt and reconsideration of the conceptual range of the notion of ‘civilization’ itself. The archetype of two Americas is replaced by a model of four with some consideration given to indigenous civilizations as a fifth America. (shrink)

The complexity of biobank research raises concerns about individuals’ understanding of the information conveyed in the consent process for such research.. We report the results of a qualitative, cognitive interview study with an ethnically, linguistically, and educationally diverse sample of 43 respondents to assess the clarity and utility of a multimedia tool developed for a biobank. Using weighted randomization, respondents were assigned to either view the multimedia tool or read a written consent document . The study illustrates the utility of (...) cognitive interviews for gaining insights from prospective research participants about the clarity of informed consent tools. Findings suggest that a multimedia tool is useful for communicating key messages but should be combined with a written consent document and personal interaction with the study staff. We recommend that the potential value of multimedia tools should be more rigorously tested in a randomized controlled trial. (shrink)

He sometimes speaks of ‘discernment’ or ‘insight’ but ‘disclosure’ is the word he normally favours. In what follows I shall ask: what a disclosure is, to what extent Dr Ramsey's use of the notion leads to confusions, and what questions have to be faced in order to resolve (...) these confusions. Background: Health institutions can be considered as complex organizations because they need to be prepared to receive and satisfy patients. This clientele differs from other organizations because the use of hospital services is not a matter of choice. Another motive for this difference is that, most often, the patients do not determine what services and products they will use during their stay. Although they are the clients, usually, health professionals decide which service or product they will consume. Hence, nursing care (...) delivery based on competence, efficiency and ethics represents a challenge. Objective: This critical reflection is meant to draw attention to the relevance of the ethical aspects of nurses' actions involving patients' satisfaction with nursing care. Research design: This paper highlights the responsibility of nurses to develop ethical actions in their commitment to manage and provide care with quality, commitment and efficiency. Findings and discussion: Possibilities of actions needed emerged from this discussion, such as the provision of reliable and updated information to clients, respect for standards, routines of care, exams and others, as well as clients' education, in order to further their involvement and participation in decisions concerning the care planned for them. Conclusion: The adoption of this paradigm entails a change in the performance of nurses' management and care roles, which may have to observe attitudes previously disregarded in most services provided. This is a competent book about a rich and tantalizing topic, the nature and status of the emotions aroused by fictional characters and events. The problem, simply stated, is how a person--say, a member of a theater audience--can be emotionally moved by a scene which he or she fully knows to be play-acted, the suffering on stage merely feigned. The underlying assumption, of course, is that emotions have certain cognitive presuppositions, one of which, presumably, is the actual existence of the (...) facts or states of affairs that provoke them. This suggests what the author calls "a paradox of belief" according to which one must both believe and not believe in the reality of a certain state of affairs, and the book is devoted to the resolution of this seeming paradox. He pursues a number of suggestions, beginning with what he considers the origin of the paradox in a 1975 article by Colin Radford, who argued that such emotions involve us in incoherence and inconsistency, through a number of suggestions ranging from the "reformist" to the "radical", all of which he argues to be inadequate. Boruah's own solution--which he calls "conservative"--is to distinguish what he calls the "evaluative" from the "existential" beliefs involved in emotion, insisting that essential evaluative beliefs are common to both real-life as well as fictional examples even if the latter do not satisfy existential requirements. In such cases, it is the imagination, coupled with belief, that explains the legitimacy of what the author awkwardly calls "fictional emotions.". (shrink)

I argue that beliefs about what appears possible are justified in much the same way as beliefs about what appears actual. I do so by chisholming, and then modalizing, the epistemic principle associated with phenomenal conservatism. The principle is tested against a number of examples, and it gives the intuitively correct results. I conclude by considering how it can be used to defend two controversial modal arguments, a Cartesian argument for dualism and an ontological argument for the existence of God.

Many philosophers have appealed to the PSR in arguments for a being that exists a se, a being whose explanation is in itself. But what does it mean, exactly, for something to have its explanation ‘in itself’? Contemporary philosophers have said next to nothing about this, relying instead on phrases plucked from the accounts of various historical figures. In this article, I analyse five such accounts – those of Anselm, Aquinas, Descartes, Spinoza, and Leibniz – and argue that none are (...) satisfactory. Should we abandon or restrict the PSR, then? I think that would be hasty, for many reasons. I therefore consider the prospects of explaining everything, including God, given the constraints of certain features of good explanations, and conclude with several observations about future approaches. Any theory of reduction that goes only so far as carried in Parts I and II does only half the job. Prima facie at least, there are cases of would-be reduction which seem torn between two conflicting intuitions. On the one side there is a strong intuition that reduction is involved, and a strongly retentive reduction at that. On the other side it seems that the concepts at one level cross-classify those at the other level, so that there is no (...) way to identify properties at one level with those at the other. There is evidence to suggest that there will be no unique mental state/neural state association that can be set up, because, e.g., many different parts of the nervous system are all capable of taking over ‘control’ of the one mental function. And it is alleged that infinitely many, worse: indefinitely many, different bio-chemo-physical states could correspond to the economic property ‘has a monetary system of economic exchange’; and similarly for the property ‘has just won a game of tennis’. Yet one doesn't want an economic system or a game of tennis to be some ghostly addition to the actual bio-chemo-physical processes and events involved. Similarly one hopes that neurophysiology allied with the rest of natural science will render human experience and behaviour explicable. (shrink)

They are compared with each other and with leading non-religious existentialists. The major themes studied include reason, freedom, the self, belief, hope, love, suffering, and immortality.

Originally published in 1981, this book provides a detailed account of the emergence of the children's rights movement, and analyses the concept of a right. It considers the justifications which may be sought when rights are claimed. Particular attention is given to the problem which arises when different rights are seen to be in conflict with each other or with other kinds of moral consideration. These arguments are then examined with regard to such special features of children as their incomplete (...) but developing rationality and their material dependence on adults. (shrink)
